SYSTEM OF INDUSTRIAL PROPERTY EXAMINATION

System of examination which is one of the important elements of national intellectual property system, at present is comprised' of by four examination divisions at Kyrgyzpatent, examination of inventions and utility models; examination of trade marks and industrial designs; examination of selective achievements, examination of trade names, in which are estimated more than 25 experts with different level of proficiency and qualification. Institute of supernumerary experts is on the stage of introduction comprised from more authoritative scientists and practitioners which are represented different fields of activity, science and technique.

Examination of applications for the title of protection granting is carried out on the base of materials, submitted by the applicant; funds of granted titles of protection; fund of non-withdrawn applications; fund of international marks presented on ROMARIN compact disks; materials of republic patent fund; search reports of domestic and foreign organizations with which relevant agreements have concluded; manual and other non-patent literature. Development of examination system is planed in following directions:

  1. Transition from "coming-checking" system of examination to checking system of examination of applications on inventions and industrial designs. Preparation to transition to prolonged system of examination.

  2. Replenishment of patent fund and non-patent literature to the extent ofPCT minimum, which is necessary to conduct substantive examination.

  3. Transition from paper technology of filing and consideration of applications to electronic.

  4. Participation in modernization and development of PCT system and Madrid system of international registration of marks.

  5. Investigation of possibility and expediency of joining to international treaties;Hague System Concerning the International Deposit of Industrial Designs;

    • Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure;

    • Madrid Protocol on International Registration of Marks;

    • WIPO Treaty on Trade Mark Law;

    • WIPO Patent Law Treaty;

    • International Convention on the Protection of Selective Achievements;

    • Lisbon Agreement for the Protection of Appellations of Origin and their International Registration.
