HISTORY OF KYRGYZPATENT DEVELOPMENT

15.06.1993 - Patent Department (Kyrgyzpatent) under the State Committee on Science and New Technologies was established by the Decree of the Government of the Kyrgyz Republic No 262 for the implement ion of unified state policy in the field of creation and legal protection of industrial property.

02.08.1993 - entered into the force “The Provisional Regulations on Industrial Property in Kyrgyz Republic” regulated relations connected with the creation and usage of industrial property subject matters, that was the starting point for the functioning of patent system in Kyrgyz Republic.

14.02.1994 - With the accession to the Convention establishing WIPO, Kyrgyz Republic became a member of the World Intellectual Property Organization (WIPO) and joined to the Paris Convention for the Protection of Industrial Property; Madrid Agreement Concerning the International Registration of Marks, Patent Cooperation Treaty (PCT).

13.01.1995 - By the Decree of the Government of the Kyrgyz Republic No13 Patent Department under the State Committee on Science and New Technologies reformed into the General Department of Intellectual Property of the Ministry of Education and Science.

16.08.1995 - An International Seminar “Protection of Industrial Property” was carried out with the participation of Mr. Francois Curchod Deputy Director General.

29.09.1995 - Instrument of Ratification on accession of the Kyrgyz Republic to the Eurasian Patent Organization has signed by the President of the Kyrgyz Republic.

13.10.1995 - signed an Agreement between the Governments of the Kyrgyz Republic and Russian Federation on cooperation in the field of industrial property protection.

13.01.1996 - Eurasian Patent Convention entered into the force in Kyrgyz Republic.

04.03.1996 - By the Decree of the President of the Kyrgyz Republic “On structure and composition of the Government of the Kyrgyz Republic” General department of intellectual property under the Ministry on Education and Science reformed into the State Agency of Intellectual Property under the Government of the Kyrgyz Republic with the status of the state management authority, that carries out functions of the state agency on patents, trade marks, copyright and related rights (hereinafter - intellectual property subject matters) and implementing the unified state policy in the field of creation, legal protection and industrial property usage, including protection on inventions, utility models, industrial designs, trade marks, appellation of origin, trade names (hereinafter - industrial property subject matters), in the field of legal protection of selective achievements (plant varieties and animal breeds), as well as in the field of legal protection of works of science, literary, art, computer programs, data base and topology of integrated circuits (hereinafter - copyright subject matters), performances, phonograms, plays, broadcasts of broadcasting organizations (hereinafter - related rights).

28.05.1996 - in cooperation with the International Union for the Protection of New Varieties of Plants (UPOV) with participation of Mr. Barry Greengrass Vice Secretary General was held the national seminar on legal matters of new varieties of plants.

28.09.1996 - First kyrgyz titles of protection has intrusted by the President of the Kyrgyz Republic.

11-16.11.1996 - in cooperation with WIPO, an international seminar “Protection of New Varieties of Plants according to the WIPO Convention”, was carried out.

24.12.1996 - signed an Agreement between the Governments of the Kyrgyz Republic and Republic of Uzbekistan on cooperation in the field of industrial property protection.

20.02.1997 - By the Decree of the Government of the Kyrgyz Republic No91 “Temporary regulations on copyright and related rights”, has confirmed, that regulates relations connected with the creation and usage of works of literature, science and art.

08.04.1997 - signed an Agreement between the Governments of the Kyrgyz Republic and Republic of Kazakhstan on cooperation in the field of industrial property protection.

21.04.1997 - signed an Agreement between the governments of the Kyrgyz Republic and Republic of Armenia on cooperation in the field of industrial property protection.

23.04.1997 - signed an Agreement between the Governments of the Kyrgyz Republic and Republic of Azerbaijan on cooperation in the field of industrial property protection.

03.11.1997 - signed an Agreement on cooperation concerning the general and technical documentation between Kyrgyzpatent and National Institute of Industrial Property of France.

05.12.1997 - Legislative Assembly of Jogorku Kenesh has adopted the II part of the Civil Code of the Kyrgyz Republic that consists of chapter 5 “Intellectual Property”.

16.12.1997 - Legislative Assembly of Jogorku Kenesh has adopted the Patent Law of the Kyrgyz Republic.

06.12.1997 - Legislative Assembly of Jogorku Kenesh has adopted the Law of the Kyrgyz Republic “On Trade Marks, Service Marks and Appellation of Origin”.

16.12.1997 - Legislative Assembly of Jogorku Kenesh has adopted the Law of the Kyrgyz Republic “On Copyright and Related Rights”.

23.01.1998 - Law of the Kyrgyz Republic “On Copyright and Related Rights” has introduced into action.

28.01.1998 - Law of the Kyrgyz Republic “On Ttrade Marks, Service Marks and Appellation of Origin” has introduced into action.

04.02.1998 - Patent Law of the Kyrgyz Republic has introduced into action.

26.01.1998 - Legislative Assembly of Jogorku Kenesh has adopted the Law of the Kyrgyz Republic on accession to the International Classification Agreements in the field of industrial property:

• Locarno Agreement Establishing an International Classification for Industrial Designs;
• Vienna Agreement Establishing an International Classification of the Figurative Elements of Marks;
• Nice Agreement Concerning the International Classification of Goods and Services for the Purposes of the Registration of Marks;
• Strasbourg Agreement Concerning the International Patent Classification.

01.03.1998 - second part of the Civil Code of the Kyrgyz Republic has introduced into action.

02.03.1998 - By the Legislative Assembly of Jogorku Kenesh, were adopted, Laws of the Kyrgyz Republic “On Legal Protection of Computer Programs and Data base”, “On Legal Protection of Topology of Integrated Circuits” and “On Commercial Secret”.

18.03.1998 - People’s Representative Assembly of Jogorku Kenesh has adopted the Laws on accession to the International Classification Agreements in the field of industrial property.

17.04.1998 - Laws on accession to the International Classification Agreements in the field of industrial property has introduced into action.

20.12.1998 - accession to the World Trade Organization (WTO) (TRIPS Agreement).

08.07.1999 - accession to the Berne Convention for the Protection of Literary and Artistic Works.

25-27.08.1999 - with the assistance of the World Intellectual Property Organization (WIPO), an international seminar on the protection of copyright and related rights subject matters for Central Asian Countries, was carried out.

02-05.11.1999 - Eight meeting of the Administrative Council of the Eurasian Patent Organization was carried out.
